It’s National Conveyancing Week – The Role of a Conveyancer

What exactly does a conveyancer do, and why are they essential?  Nexa Law’s Licensed Conveyancer Samantha Hinton explains her role and the intricacies involved.

Buying or selling a property is one of the most significant decisions in a person’s life and can be fraught with excitement, apprehension, and stress.  It’s not uncommon for clients to experience anxiety or uncertainty during the process.  A conveyancer can offer reassurance, guidance, and a listening ear.

Conveyancing involves investigating (often extensive) title deeds, uncovering any hidden issues and finding solutions, guiding clients through legal jargon, keeping an eye on any changes in legislation which can affect current transactions, such as changes to Stamp Duty Land Tax which can sometimes take immediate effect, always whilst doing the best to adhere to client’s timescales.

Conveyancing is not just about buying and selling property; there’s often a tale behind the transaction, such as separation, financial difficulties or death.  Conveyancers must possess excellent communication skills and empathy.  They must listen attentively to their clients’ concerns, empathise with their anxieties and provide clear explanations to alleviate any confusion. Building trust and rapport with clients is crucial, as it creates a supportive environment where clients feel comfortable expressing their worries and seeking advice.  On more than one occasion after talking through a client’s concerns, I’ve been told I should include therapist in my job description!

Being a conveyancer is more than just facilitating property transfers; it requires a delicate balance between legal expertise and emotional intelligence.  It’s about supporting and guiding clients through one of the most significant decisions of their lives with empathy, patience, and understanding.
